LOCATION & GENERAL INFORMATION

The Boyer property is located in Section 20, T66N∙R6W, Des Moines Township, Lee County, Iowa and is generally located 2 ½ miles southwest of Argyle, Iowa along 175th Avenue.  The land is nearly 100% timber with 25.69 acres in Forest Reserve (current real estate taxes = $64.00).  It represents premier whitetail habitat (located in an area known for their record bucks) has thick brush, bedding areas, small stream and approximately 1.5 acres tillable.

 TERMS & CONDITIONS

  1. PROCEDURE: Bidding ends Friday, January 8th at 1:00 P.M., with a soft close, meaning that a last-minute bid will extend the bidding by 3 minutes until the bidding becomes idle. Land will be sold by the price per acre times the number of surveyed acres.
  2. ACCEPTANCE OF BIDS: Winning bidder will enter into a Contract to Purchase immediately upon being declared the Successful Bidder by the Auctioneer.  Upon the close of the auction, the winning bidder will be forwarded via email a Contract to Purchase.  Fraise Auction & Real Estate must receive a signed copy of the contract on or before 12:00 NOON, Monday, January 11th (DocuSign, faxed, scanned or emailed). This real estate sells subject to Seller’s confirmation.
  3. DOWN PAYMENT: $7,500 nonrefundable earnest money deposit will be due upon acceptance of the Contract to Purchase.  Bidding is not contingent upon Buyer’s financing or any other contingencies. This real estate sells “as is, where is” with no warranties expressed or implied.
  4. CLOSING: Closing shall occur within 45 days or as soon thereafter as applicable closing documents are completed.
  5. POSSESSION: Possession will be given at closing.  The tillable acres sell subject to tenant’s rights for the 2021 crop year (there is no lease payment).
  6. ABSTRACT & TITLE: Sellers will provide a current abstract at their expense.
  7. SURVEY: Seller has completed a survey of the property.
  8. Special Provisions: The real estate is selling subject to public road easements, utility easements and all other easements of record.  The Buyer should be aware that an area of the property was formerly used as a trash/ scrap iron dump site. A majority of this has been removed, but there could still be remnants. If, in the future, a site cleanup is required, it will be the sole responsibility of the Buyer.  
  9. ACCESS: The property has road frontage from 175th Avenue – the Buyer will be responsible in installing a new driveway to access the property.
  10. REAL ESTATE TAXES: Taxes will be prorated to the date of closing.
