METHOD AND TERMS
Procedure: Property will be offered in three individual tracts. All bids will be on a total price “lump sum” basis. This is a soft close auction, meaning that if a bid is placed in the final three minutes of the scheduled close of the auction, it will extend bidding by three minutes until all bidding is completed. All three tracts are linked together and bidding extensions will extend all three tracts, so that they will close simultaneously.
Contract of Title: Immediately upon conclusion of the auction, the high bidder(s) will enter into a real estate sales Contract to Purchase and deposit with Fraise Auction & Real Estate the required earnest money payment. The Seller will provide a current abstract at their expense. Sale is not contingent on Buyer’s financing or any other contingencies. All sales are final.
Earnest Money Payment: $7,500 earnest money payment for each tract is required on the day of the auction. The earnest money payment may be paid in the form of cash, guaranteed check or wire transfer. All funds will be held in Fraise Auction & Real Estate’s Trust Account.
Closing: Closing will occur on or about Monday, June 22, 2020. The balance of the purchase price will be payable at closing in the form of guaranteed check or wire transfer.
Possession: Possession will be given at closing, upon payment in full.
Real Estate Taxes: The real estate taxes will be prorated to the date of the closing based on the last available tax statement.
Septic System: Buyer(s) of Tract 1 will be responsible for any inspections, repairs and/or updates as required by law.
Under no circumstances shall Bidder(s) have any kind of claim against Fraise Auction & Real Estate, its affiliates or the Sellers if the internet service fails to work correctly during the auction.
